1. Who we are and acceptance of these Terms

These Terms of Service (“Terms”) are a binding agreement between you and IronMend LLC, a Texas limited liability company (“IronMend,” “we,” “us”), located at 2310 N Henderson Ave, Ste B #1102, Dallas, Texas 75206. By accessing ironmendllc.com (the “Site”), creating an account, or placing an order, you accept these Terms. If you do not agree, do not use the Site.

2. What IronMend is, and what it is not

IronMend operates a platform that lets you request wellness-focused compounded therapies. IronMend is not a medical practice, pharmacy, or healthcare provider, and does not practice medicine. All medical review is performed by independent licensed providers, and all products are prepared and dispensed by independent US-licensed compounding pharmacies. IronMend does not direct, control, or influence any clinical decision.

Nothing on the Site is medical advice. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.

3. Eligibility and availability

You must be at least 18 years old, reside in the United States, and be located in a state where our providers and partner pharmacies operate. Product availability varies by state; we may decline or cancel orders that cannot be lawfully fulfilled in your state. You agree that the information you provide, including your medical intake, is accurate and complete. Providing false information may result in denial of service and can be dangerous to your health.

4. How ordering works

When you place an order: (a) you submit a request and a medical intake; (b) an independent licensed provider reviews it and decides, in their sole clinical judgment, whether the requested therapy is appropriate for you; (c) your payment method is charged when you place your order, and refunded in full if a provider does not approve it; (d) approved orders are prepared and shipped by a licensed pharmacy in up to 5 business days. Therapies that require a consultation are priced after your visit and are not charged at checkout. Provider review is never a guarantee of approval, and an unapproved order costs you nothing.

5. Refunds, cancellations, and shipping

In short: not approved means no charge; cancel any time before shipment for a full refund; because compounded medications cannot be restocked or resold, all sales are final after delivery; damaged or lost shipments are handled case by case, so contact us and we will make it right.

6. Compounded medications: important disclosures

Products offered through IronMend are compounded medications prepared by US-licensed 503A/503B compounding pharmacies. Compounded medications are not FDA-approved; the FDA does not review compounded drugs for safety, effectiveness, or quality before marketing. They are not generic versions of any approved drug. Individual results vary, and no outcome is promised or implied.

7. Telehealth consent

By submitting an order and intake, you consent to receive care by asynchronous telehealth as described in our Telehealth Informed Consent, which is incorporated into these Terms.

8. Accounts

You are responsible for your account credentials and for all activity under your account. Tell us immediately at carloruggiero08@ironmendllc.com if you suspect unauthorized use. We may suspend accounts used in violation of these Terms.

9. Prohibited uses

You agree not to: misrepresent your identity or health information; order products for anyone other than yourself; resell or distribute any product; use the Site to violate any law; probe, scrape, or disrupt the Site; or infringe our intellectual property. All Site content is owned by IronMend LLC and protected by applicable IP laws.

10. Disclaimers and limitation of liability

The Site is provided “as is” without warranties of any kind. To the fullest extent permitted by law, IronMend’s total liability for any claim arising out of these Terms or your use of the Site is limited to the amount you paid us in the twelve months before the claim, and IronMend is not liable for indirect, incidental, special, or consequential damages. IronMend is not liable for the acts or omissions of independent providers or pharmacies. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Dispute resolution: arbitration and class-action waiver

Please read this section carefully; it affects your legal rights. Any dispute arising out of these Terms or your use of IronMend will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be held in Texas or conducted remotely at your election. For claims under $10,000, IronMend will pay the arbitration fees. You and IronMend each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative proceeding.

Exceptions: either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for intellectual-property misuse. Opt-out: you may opt out of this arbitration agreement by emailing carloruggiero08@ironmendllc.com with the subject “Arbitration Opt-Out” within 30 days of first accepting these Terms.

12. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to Section 11, any court proceeding must be brought in the state or federal courts located in Texas, and you consent to their jurisdiction.

13. Changes, severability, entire agreement

We may update these Terms; material changes will be posted with a new effective date, and continued use after posting is acceptance. If any provision is found unenforceable, the rest remain in effect (and if the class-action waiver is found unenforceable, the entire Section 11 is void). These Terms, together with the policies they link to, are the entire agreement between you and IronMend.
